These terms govern the supply of infrastructure and related services by COZQ Limited, trading as Stone Hosting, to customers in the United Kingdom. They are written for a UK hosting context: clear allocation of responsibility between provider and customer, compliance with applicable law, and practical abuse and security expectations.

1. Definitions

  • “We”, “us”, “our” - COZQ Limited (company number 16592649), trading as Stone Hosting, registered in England and Wales. Registered office: 20 Wenlock Road, London, England, N1 7GU.
  • “You”, “your”, “customer” - the person or entity that orders or uses our services.
  • “Services” - dedicated or bare-metal hosting, connectivity, colocation, and ancillary services we agree to provide, as described in your order or service description.
  • “Equipment” - hardware and network assets we allocate to you or host on your behalf.
  • “Customer data” - data you store, process, or transmit using the services (including on systems you control).

2. Formation of contract

A contract is formed when we accept your order (in writing, by email, through a billing portal, or by commencing provision). These terms apply together with any service-specific description, quotation, or order form. If there is a conflict, the order-specific document prevails only where it expressly states that it overrides these terms.

You confirm that you have authority to bind any organisation on whose behalf you order. Our privacy policy describes how we process personal data in connection with the services.

3. Provision of services

We will provide the services with reasonable skill and care, in line with the specifications agreed at order. Unless expressly agreed as a managed service, you are responsible for the operating system, applications, security configuration, patching, backups, and compliance of your workloads with law and industry standards.

UK data centre footprint

Infrastructure is located in the United Kingdom unless we agree otherwise in writing. Cross-border transfers of personal data, if any, are handled as described in our privacy policy.

4. Availability and maintenance

Where we publish or agree a service level (for example network or power availability), that commitment applies to the infrastructure under our control, not to software, misconfiguration, or issues outside our network. Scheduled maintenance will, where reasonably practicable, be announced in advance. Emergency work may be performed without notice where necessary to protect security or stability.

Credits or remedies for qualifying failures, if any, are limited to what we expressly state in writing for your service tier. Unless otherwise agreed, we do not guarantee uninterrupted service and exclude indirect or consequential loss to the extent permitted by law (see below).

5. Your obligations

You agree to:

  • - Use the services only lawfully, including the Computer Misuse Act 1990, Data Protection Act 2018, UK GDPR, copyright and trade mark law, and regulations applicable to your sector (for example financial services or telecommunications where relevant).
  • - Maintain accurate account and billing details and adequate security (credentials, encryption, access control) for systems you operate.
  • - Not resell or share access except as permitted by your plan and our written consent where required.
  • - Co-operate with reasonable requests for information when investigating abuse, security incidents, or legal process directed at us in relation to your service.

6. Acceptable use policy

The following are prohibited and may result in immediate suspension or termination without refund where serious or repeated:

  • Unauthorised access to systems, networks, or data (including scanning or exploitation without permission).
  • Hosting or distributing malware, botnet command infrastructure, phishing, or other materially harmful content.
  • Originating or facilitating denial-of-service attacks, reflection, or amplification against third parties.
  • Unsolicited commercial email or SMS in breach of PECR or good industry practice (including open relays and purchased lists without valid consent).
  • Content or activity that is illegal in the United Kingdom, or that exposes us to criminal liability or regulatory sanction.
  • Excessive resource use that materially degrades shared facilities or other customers, where applicable.

Crypto-asset mining or high-intensity workloads may require prior written approval and an appropriate service tier. We may publish supplementary policies (for example email or backup); they form part of these terms when referenced at order or on our website.

7. Abuse reports and law enforcement

We may investigate reports from third parties, regulators, or law enforcement. We may preserve and disclose information where required by UK law or a court order, or where necessary to protect rights, safety, or the integrity of our network. You will not interfere with such investigations beyond what the law allows.

8. Intellectual property and your content

You retain ownership of customer data and grant us only the licence reasonably required to provide the services (for example hosting, support you request, and billing). You warrant that your use of the services does not infringe third-party rights. Our name, branding, and documentation remain our property.

9. Fees, VAT, and payment

Unless we state otherwise in writing, prices we publish or quote include VAT at the applicable UK rate. Your invoice may still show VAT separately for accounting purposes. If the UK VAT rate changes, we may adjust inclusive prices or the VAT element accordingly. Custom quotations, add-ons, or exempt supplies will be identified clearly if different rules apply.

Recurring fees are billed in advance unless agreed otherwise. Late payment may attract statutory interest under the Late Payment of Commercial Debts (Interest) Act 1998 (where applicable) and suspension of services after reasonable notice.

10. Suspension

We may suspend services without liability where necessary to comply with law, mitigate an attack or abuse, recover amounts due after notice, or prevent imminent harm. We will use reasonable endeavours to notify you and restore service when the issue is resolved, except where notice is unlawful or counterproductive.

11. Limitation of liability

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law. Subject to that:

  • - We are not liable for loss of profits, revenue, goodwill, data, or indirect or consequential loss.
  • - Our total aggregate liability arising out of or in connection with the services in any twelve-month period is limited to the total fees you actually paid us for those services in that period, except for the categories that cannot be capped above.

You are responsible for maintaining your own backups and business continuity arrangements appropriate to your risk. Unmanaged infrastructure carries inherent operational risk; you accept that allocation.

12. Term, termination, and data

Services run for the initial term agreed and renew as stated in your order (for example monthly or annually) until terminated. Either party may terminate for material breach not remedied within thirty days of written notice (or immediately where breach is not capable of remedy or involves serious illegality).

On termination you must cease use and pay amounts due. We may delete or return customer data in line with our retention practices described in the privacy policy. Retrieve your data before cancellation where possible.

13. Governing law, disputes, and notices

These terms are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction, subject to any mandatory rights you have as a consumer where applicable. Notices should be sent to the contact details we publish (including via our contact channels).
