This agreement is in effect as of 10th October 2015.
We reserve the right to change this User Agreement from time to time without notice. You acknowledge and agree that it is your responsibility to review this User Agreement periodically to familiarise yourself with any modifications. Your continued use of this site after such modifications will constitute acknowledgement and agreement of the modified terms and conditions.
Responsible Use and Conduct
By visiting our website and accessing the information, resources, services, products, and tools we provide for you, either directly or indirectly (hereafter referred to as 'Resources'), you agree to use these Resources only for the purposes intended as permitted by (a) the terms of this User Agreement, and (b) applicable laws, regulations and generally accepted online practices or guidelines.
Wherein, you understand that:
a. In order to access our Resources, you may be required to provide certain information about yourself (such as identification, contact details, etc.) as part of the registration process, or as part of your ability to use the Resources. You agree that any information you provide will always be accurate, correct, and up to date.
b. You are responsible for maintaining the confidentiality of any login information associated with any account you use to access our Resources. Accordingly, you are responsible for all activities that occur under your account/s.
c. Accessing (or attempting to access) any of our Resources by any means other than through the means we provide, is strictly prohibited. You specifically agree not to access (or attempt to access) any of our Resources through any automated, unethical or unconventional means.
d. Engaging in any activity that disrupts or interferes with our Resources, including the servers and/or networks to which our Resources are located or connected, is strictly prohibited.
e. Attempting to copy, duplicate, reproduce, sell, trade, or resell our Resources is strictly prohibited.
f. You are solely responsible any consequences, losses, or damages that we may directly or indirectly incur or suffer due to any unauthorised activities conducted by you, as explained above, and may incur criminal or civil liability.
g. We may provide various open communication tools on our website, such as blog comments, blog posts, public chat, forums, message boards, newsgroups, product ratings and reviews, various social media services, etc. You understand that generally we do not pre-screen or monitor the content posted by users of these various communication tools, which means that if you choose to use these tools to submit any type of content to our website, then it is your personal responsibility to use these tools in a responsible and ethical manner. By posting information or otherwise using any open communication tools as mentioned, you agree that you will not upload, post, share, or otherwise distribute any content that:
i. Is illegal, threatening, defamatory, abusive, harassing, degrading, intimidating, fraudulent, deceptive, invasive, racist, or contains any type of suggestive, inappropriate, or explicit language;
ii. Infringes on any trademark, patent, trade secret, copyright, or other proprietary right of any party;
Iii. Contains any type of unauthorized or unsolicited advertising;
Iiii. Impersonates any person or entity, including any www.StoneHosting.co.uk employees or representatives.
We have the right at our sole discretion to remove any content that, we feel in our judgement does not comply with this User Agreement, along with any content that we feel is otherwise offensive, harmful, objectionable, inaccurate, or violates any 3rd party copyrights or trademarks. We are not responsible for any delay or failure in removing such content. If you post content that we choose to remove, you hereby consent to such removal, and consent to waive any claim against us.
i. You agree to indemnify and hold harmless Stone Hosting and its parent company and affiliates, and their directors, officers, managers, employees, donors, agents, and licensors, from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of this User Agreement or the failure to fulfill any obligations relating to your account incurred by you or any other person using your account. We reserve the right to take over the exclusive defence of any claim for which we are entitled to indemnification under this User Agreement. In such event, you shall provide us with such cooperation as is reasonably requested by us.
By purchasing our services, you as a "Buyer" are bound by our refund policy.
Stone Hosting offers a 7 day no-fuss money back guarantee on web hosting services ONLY. This applies to any type of billing cycle you choose.
The Buyer may be entitled to a refund which can be redeemed upon request and must be paid back to the original payment method which is used when placing the order within 7 days’ services being approved/activated.
In order to be entitled you must not have subscribed to any of the following services: -
Where you are entitled to a refund of any kind, the Buyer accepts that you will only receive a partial payment which is calculated based on your usage (Pro rata) and therefore once your service has been activated, you would not be entitled for a refund of any time which has already been spent since the activation. Note that in extreme circumstances this can be overridden at the agents digression to provide a full refund providing you contact us within 7 days of the account/service being activated.

* These terms may be changed at any time with or without any notice and therefore we ask that you read these terms on a regular basis.
If you wish to cancel any of your services with us, please submit a cancellation request from inside your client manager portal. Please Note: To cancel your services, we require 30 days’ notice.
Our cancellation terms are straight forward. They are just like a 30 day rolling SIM contract. This means that you're not tied into a contract, you can request to cancel the SIM with 30 days notice at any time from the date of the request or the date of your server start date.
Limitation of Warranties
By using our website, you understand and agree that all Resources we provide are "as is" and "as available". This means that we do not represent or warrant to you that:
i) the use of our Resources will meet your needs or requirements.
ii) the use of our Resources will be uninterrupted, timely, secure or free from errors.
iii) the information obtained by using our Resources will be accurate or reliable, and
iv) any defects in the operation or functionality of any Resources we provide will be repaired or corrected.
Furthermore, you understand and agree that:
v) any content downloaded or otherwise obtained through the use of our Resources is done at your own discretion and risk, and that you are solely responsible for any damage to your computer or other devices for any loss of data that may result from the download of such content.
vi) no information or advice, whether expressed, implied, oral or written, obtained by you from Stone Hosting or through any Resources we provide shall create any warranty, guarantee, or conditions of any kind, except for those expressly outlined in this User Agreement.
Limitation of Liability
In conjunction with the Limitation of Warranties as explained above, you expressly understand and agree that any claim against us shall be limited to the amount you paid, if any, for use of products and/or services. Stone Hosting will not be liable for any direct, indirect, incidental, consequential or exemplary loss or damages which may be incurred by you as a result of using our Resources, or as a result of any changes, data loss or corruption, cancellation, loss of access, or downtime to the full extent that applicable limitation of liability laws apply.

We aim for 100%. Uptime is one of our main priority. In the event of downtime, we will look at crediting you for the time lost in certain circumstances. Each downtime case is different in its own right.
All content and materials available on www.StoneHosting.co.uk, including but not limited to text, graphics, website name, code, images and logos are the intellectual property of Stone Hosting and are protected by applicable copyright and trademark law. Any inappropriate use, including but not limited to the reproduction, distribution, display or transmission of any content on this site is strictly prohibited unless specifically authorised by Stone Hosting.
Termination of Use
You agree that we may, at our sole discretion, suspend or terminate your access to all or part of our website and Resources with or without notice and for any reason, including, without limitation, breach of this User Agreement. Any suspected illegal, fraudulent or abusive activity may be grounds for terminating your relationship and may be referred to appropriate law enforcement authorities. Upon suspension or termination, your right to use the Resources we provide will immediately cease, and we reserve the right to remove or delete any information that you may have on file with us, including any account or login information.
Late Payment Fees
Sadly in the event that your account has outstanding invoices that have had no attempt to contact our billing department to explain the reason for missed payment, your account may result in a late payment charge of £15.00 a day for 7 days** and/or your account frozen until payment is made by Credit/Debit Card, Bank Transfer or other means of payment. If a payment is not made, your service will be cancelled and the option to make further orders will be revoked. However, if your reason is genuine we are not robots! we will help you out as much as possible. We will waive the fees that the system automatically puts onto your account if you contact us before your invoice date and explain your reason for not being able to pay by phone or using your client ticket system.** Note this is at the discretion of our accounts department.
Add Funds and/or Overpayments
By adding funds (credit) to your account, our system will take any credit from your balance and apply it to all/any unpaid invoices automatically. All deposits & overpayments are non-refundable. However, you will be credited with the amount you 'Add' or 'Overpay. Please Note: Any overpayments not claimed within 24 hours will expire.
Unacceptable uses also include, but are NOT limited to: Bulk emailing, unsolicited emailing, newsgroup spamming, upload scripts (Rappidleach), pornographic content, illegal content, copyright infringement, trademark infringement, warez sites (including links to/from), cracks, software serial numbers, proxy-relaying, link farming (the act of or by use of scripts), link grinding, link-only sites, spamdexing, FFA (Free-For-All) and/or anything else determined by Stone Hosting Limited to be unacceptable use of our services including abuse of server resources.
IMPORTANT NOTE: Stone Hosting Limited has the right to discontinue service, or deny access to anyone who violates our policies or the terms and conditions shown below WITHOUT WARNING or PRIOR NOTICE. No refunds of fees paid will be made if account termination is due to violation of the terms outlined above.
Irresponsible Usage for VPS & Dedicated Servers
The customer accepts and acknowledges that they have a responsibility to ensure that their Stone Hosting products and services are not used in an irresponsible manner. Activities deemed to be irresponsible by Stone Hosting Limited include, but are not limited to, bulk unsolicited e-mailing (spamming), the hosting of fraudulent or ‘phishing’ sites, the use of Stone Hosting Limited products and services in an attempt to circumvent the security of third party machines and networks and the exceeding of service quotas allocated to your product (i.e. exceeding data transfer allocation). The use of email address lists obtained from third parties is not allowed. Email address lists may be used for sending bulk emails only if they are compiled from opt-in registration on the customer's own site.
Stone Hosting services must not be used for:
The hosting of adult content
The transit of VPN tunnels where neither end of the tunnel terminates on the Stone Hosting service
Any open recursive DNS services
Use of the following technologies is not permitted without the prior consent of Stone Hosting:
Connection to p2p or bit torrent networks
Running IRC servers
Running proxy servers of any type
The sending of bulk emails, defined as the sending of the same email, or emails which are substantially the same, to more than ten email addresses.
Any offer of ‘unlimited bandwidth’ associated with any hosting product is made on the condition that the hosting service will not be used for:
Streaming including but not limited to Shoutcast services, video or audio conferencing or streaming, or the real-time delivery of media files
Use of virtualisation techniques which split your server into two or more virtual machines
Stone Hosting reserves the right to suspend or cancel any service on any shared platform (including Virtual Servers & Dedicated Servers) which is affecting the ability of the platform to provide acceptable levels of service to other services on the same platform. If we determine that a customer’s products are being used irresponsibly we will notify you via e-mail of the situation. If you have not acted to resolve the reported issue within 24 hours we reserve the right to suspend your services immediately and indefinitely until such a time that the reported issue(s) are resolved. Failure to resolve the issue(s) in a timely fashion could result in the termination of your Stone Hosting Limited products and services.
If we determine that a customer’s products are being used in breach of this AUP, we reserve the right to suspend the customer’s service immediately and without prior notification. You will be informed of the suspension and if you have not acted to resolve the reported issue within 24 hours we reserve the right to terminate your Stone Hosting products and services on a given date.
This website is controlled by Stone Hosting. It can be accessed by most countries around the world. By accessing our website, you agree that the statutes and laws of our state, without regard to the conflict of laws and the United Nations Convention on the International Sales of Goods, will apply to all matters relating to the use of this website and the purchase of any products or services through this site.
Furthermore, any action to enforce this User Agreement shall be brought in the federal or state courts You hereby agree to personal jurisdiction by such courts, and waive any jurisdictional, venue, or inconvenient forum objections to such courts.
Domains - Registration Transfer, Registration Renewal, Registrar Transfer In/Out
You are able, at various times to process a change of your domain name license. These times are strictly limited to those mentioned within this document which includes the policies and requirements of the relevant domain registry(s).
A registrant transfer transfers ownership of a domain name license from one registrant to another. A registrant transfer consists of a transferor (old registrant) and a transferee (new registrant).
In order to successfully complete registrant transfer you must:
Provide to us a complete Domain Transfer of Ownership form, as available on our website. The information on this form must be correct, valid and satisfy the requirements set out by the related registry operator.
Ensure that the transferor pays any outstanding fees owing to us.
Updating your domain details may carry a charge.
Pay any specified fee's relating to the process of a registrant change.
Supply satisfactory documentation identifying both the transferor and transferee.
Ensure that the Transferee, in accordance with the Domain Transfer of Ownership form acknowledges the entry of this service agreement, our policies, and any requirements/policies of the related registry operator. The transferor releases us from any claims arising under or in relation to this agreement, their domain name license or its transfer as soon as the transfer is affected.
You are able (subject to the policy of the relevant registry operator) apply for the transfer of a domain name license from another domain registrar (company) to ours. A registrar transfer to us is treated as an application for registration in that all clauses in this document are equally applicable. By applying for registrar transfer you agree with this service agreement and any policies as listed by us or the relevant registry operator.
As you are able to process a registrar transfer to us, you are also able to apply for a registrar transfer to another company. A transfer out is governed by the clauses of this document with reference to the specific section which pertains to the domain name which you are applying to transfer (.e.g. .com, .co.uk, etc).
An Application Fee of £80.00 will be applied before a domain is released, transferred, details changed/updated. Or a yearly fee of £80.00 for DNS Management will apply. Furthermore, all domain(s) that fall under the redemption period are subject to fee's that are as follows: 1-50 days £150.00 note this price does not include the renewal of the domain. After such time your domain may not be recoverable and publicly open for others to buy and use as they wish. You agree you will not hold us responsible for any damages caused as we send emails relating to the renewal of your domain(s) a minimum of 3 times before the domain expires. Failure to respond and renew your domain will result in domain expiring.
Our hosting packages when set-up go through a strict fraud checker to see if you are who you say you are (no credit checks are completed). Our free hosting packages come with restricted functionality due to the demand. All free hosting accounts last for 30 days if unused. Furthermore, after 90 days free hosting you will be automatically upgraded to our main package "SOLO". If you wish to stay on your current hosting package you need to submit a support ticket from your client manager.
Free packages are limited to one-per-person.
